Abstract:
Argumentation from consequences plays a central role in the justification and critical scrutiny of legislative proposals. With a view to contributing to the ex ante evaluation of legislation in Chile, this paper proposes instruments for analysing and evaluating argumentation from consequences in the general discussion of a bill. The theoretical starting points are the pragma-dialectical theory of argumentation and informal logic. The analytic instrument is an argument scheme to identify arguments from consequences in legislative discourse and reconstruct implicit premises. The evaluative instrument is a set of critical questions to determine the quality—specifically, the sufficiency—of an argument from consequences put forward in the general discussion of a bill ; La argumentación por consecuencias ocupa un lugar central en la justificación y el examen crítico de los proyectos de ley. Con el propósito de contribuir al proceso de evaluación ex ante de la ley en Chile, este artículo propone herramientas para analizar y evaluar las argumentaciones por consecuencias presentadas en la discusión general de un proyecto de ley. La teoría pragma-dialéctica de la argumentación y la lógica informal sirven de marco teórico para el diseño de las herramientas. La herramienta de análisis consiste en un esquema argumentativo para identificar argumentos por consecuencias en el discurso legislativo y reconstruir premisas implícitas. La herramienta de evaluación es un conjunto de preguntas críticas para determinar la calidad —específicamente, la suficiencia— de una argumentación por consecuencias en el contexto de la “discusión general” de un proyecto
