Centro de Investigação Jurídica do Ciberespaço, 2021 Abstract: No presente artigo pretendemos contribuir para a compreensão da relação entre o crime de violência doméstica e as redes sociais, em particular a proteção jurídico-penal da vida privada na internet. Para atingir uma resposta ao ponto de partida desenvolveu-se um diálogo argumentativo e fundamentado nas questões do direito penal contemporâneo com base no método jurídico, um raciocínio lógico-dedutivo assente na triangulação da jurisprudência portuguesa e do Tribunal Europeu dos Direitos Humanos, na doutrina (nacional e estrangeira) e na legislação, com destaque para a Lei do Cibercrime, o direito penal primário e a lei civil; a par da Constituição da República Portuguesa e a Convenção Europeia dos Direitos Humanos. Nessa senda foram analisadas diversas questões de natureza material à luz do dispositivo vertido na al. b), n.º 2 do art.º. 152.º do CP, para percebermos o tipo legal que é preenchido quando o agente difunde, sem o consentimento da vítima, uma imagem relativa à intimidade da vida privada nas redes sociais. A vocação humanista e de equilíbrio social do direito penal impeliunos a avançar para o tema em discussão, contribuindo para a estruturação de uma reflexão assente em três capítulos. Nas conclusões sugerimos, à luz da jurisprudência e da doutrina, que o crime de VD é um tipo específico impróprio ou impuro e de perigo abstrato que pode criar uma relação de concurso aparente de normas com outros tipos penais, como a devassa da vida privada, p. e p. no art.º. 192.º, nº 1. al. b) ou as gravações e fotografias ilícitas, p. e p. no art.º. 199.º, n.º 2, al. b), do CP, punindo-se o agente pelo crime mais grave, in casu a violência doméstica, pois existe uma relação de subsidiariedade entre os tipos legais em concreto. ; In this paper we intend to contribute to the understanding of the dialectic between the crime of domestic violence and social networks, the legal and penal protection of private life on the internet. To reach this starting point, an argumentative dialogue based on the issues of contemporary criminal law was developed based on the legal method, a logical-deductive reasoning based on the triangulation of Portuguese jurisprudence and the European Court of Human Rights, in the doctrine (national and foreign) and in the ordinary national civillaw and criminal law, with particular emphasis on the Cybercrime Law; alongside the Portuguese Republic Constitution and the European Convention on Human Rights. In this path, several questions of a material nature were analyzed in the light of the device poured in al. b) of no. 2 of article 152 of the CP, in order to understand what legal type is fulfilled when the agent disseminates, without the victim's consent, an image related to the privacy of private life on social networks. The humanist vocation and the social balance of criminal law impelled us to move forward to the topic under discussion, contributing to the structuring of a reflection based on three chapters.
