Неоднозначные тенденции публичной ответственности за распространения заведомо ложных сведений, порочащих потерпевшего (в частности, связанные со спецификой объекта уголовно-правовой охраны и «побочным эффектом» процесса цифровизации) требуют пристального внимания в условиях современности. Цель: выделить последние качественные изменения в составе клеветы, основываясь на актуальном тексте уголовного закона, соотнести полученные данные с ситуацией в современном обществе, провести их научно-обоснованную юридическую оценку. Методологическая основа: общие и частные научные методы познания объективной действительности (диалектический, сравнительный, анализ, формально-юридический). Результаты: автор на основе проведенного анализа составов клеветы и смежных с ними преступлений, выявил новые тенденции в дифференциации уголовной ответственности за данное преступление и дал им научно-обоснованную ... : Background: this article deals with topical issues of the result of changing the attitude of the legislator to libel. Ambiguous trends of public responsibility for the dissemination of deliberately false information discrediting the victim, in particular, related to the specifics of the object of criminal legal protection and the “side effect” of the digitalization process, require close attention in modern conditions. Objective: to identify the latest qualitative changes in the composition of slander, based on the current text of the criminal law, to correlate the data obtained with the situation in modern society, to conduct their scientifically based legal assessment. Methodology: general and particular scientific methods of cognition of objective reality (dialectical, comparative, analysis, formal legal ones).
