Abstract:
Введение. Статья посвящена анализу нормативного регулирования, которое, будучи разновидностью правового регулирования, занимает особое место в системе регулирования предпринимательской деятельности. Цель. Определение особенностей и перспектив нормативного регулирования предпринимательской деятельности является целью исследования. Методология. Применялся общенаучный диалектический метод познания и вытекающие из него частнонаучные методы: логический, системно-структурный, технико-юридический, метод правового моделирования. Результаты. Нормативное регулирование в концепции позитивного права расценивается именно как регулирование посредством правовых норм, однако нормативное регулирование может включать в себя регулирование с помощью различных социальных норм. Несмотря на то, что в рамках традиционного подхода право как надстройка лишь легально закрепляет уже сложившиеся в обществе экономические отношения, государство посредством нормативного регулирования может оказывать существенное влияние на развитие ... : Introduction. The article examines normative regulation, which, as a kind of legal regulation, occupies a special place in the regulation of entrepreneurship. Purpose. The research aims at defining the features and prospects of the normative regulation of entrepreneurship. Methodology. The author used the general scientific dialectic method and specific methods arising from such as logical, system-structural, technical-legal, and legal modeling methods. Results. Normative regulation in the positive law is regarded as regulation by means of legal norms; but normative regulation may include regulation by means of various social norms. Despite the fact that according to the traditional approach, law exists only as an add-on of the established economic relations in society, the state, through regulation, can have a significant impact on the development of economic relations in certain areas of entrepreneurial activity.
