Abstract:
Die liberalen Verfassungsstaaten in Kanada und den USA sehen sich in den letzten drei Jahrzehnten verstärkt mit der Frage konfrontiert, inwieweit historisches Unrecht und dessen anhaltendes Erbe mit liberalen Vorstellungen von Rechtsstaatlichkeit vereinbar sind. Diese sowohl in der Wissenschaft als auch in der Öffentlichkeit immer vehementer geführte Debatte um Rassismus sowie Minderheitendiskriminierung in liberalen Gesellschaften zeigt auf, dass es sich bei diesen zentralen Strukturmerkmalen weniger um eine normativ konstitutive, aber zugleich verschwiegene Grammatik des Liberalismus handelt, sondern vielmehr um die Perpetuierung historischen Unrechts, das sich aus der inkonsequenten praktischen Entfaltung liberaler Ordnungsentwürfe ergibt. Dabei zeigt sich das Versagen des rechtlichen und sprachlichen Instrumentariums des Liberalismus, welches das vergangene und fortgesetzte Unrecht nicht einzuholen vermag und dadurch paradoxerweise weiter perpetuiert. ; In the last three decades, the constitutional democracies in Canada and the USA have been increasingly confronted with questions regarding the extent to which historical injustice and ist enduring legacy are compatible with liberal concepts of the rule of law. This debate about racism and discrimination in liberal societies, which is being vehemently led both in academia and in the broader public, shows that these central structural features are not symptoms of a normatively constitutive, yet concealed inherent grammar of liberalism. They are rather a consequence of historical injustices resulting from the inconsequential unfolding of liberal concepts of order. This reveals a paradoxical failing of the legal and linguistic instruments of liberalism to address past and continued injustice, leading to its continuation.
