Die Rechte und Pflichten der Frau in der türkischen Republik auf Basis türkischer Verfassungs- und Gesetzestexte
|

Abstract:
Die vorliegende Masterarbeit befasst sich mit der Stellung der türkischen Frau vor dem Gesetz. Im ersten Kapitel wird als Einstieg ein Einblick in die Entstehungsgeschichte der türkischen Verfassung geboten. Damit die einzelnen Entwicklungsstadien besser nachvollzogen werden können, ist es notwendig einen Blick in die prägende Ära der Tanẓīmāt sowie die I. und II. Konstitutionelle Periode zu werfen, angefangen vom Ḥaṭṭ-ı Şerīf (dt.: das Edle Schreiben; auch bekannt unter „Edikt von Gülhane“) aus dem Jahr 1839, über das Ḥaṭṭ-ı Hüma̅yūn (dt.: das Großherrliche Schreiben) von 1856 und weiter zu der ersten offiziell gültigen Verfassung von 1876, über die Ausrufung der Republik bis hin zu der bis dato Gültigkeit tragenden Verfassung aus dem Jahr 1982. Die Auswirkung dieser Gesetze auf das Leben der Frauen wird dabei besonders berücksichtigt. Der folgende Abschnitt beschäftigt sich mit der Persönlichkeit, die noch heute als der Begründer der türkischen Frau und ihrer Rechte gefeiert wird, nämlich Mustafa Kemal Atatürk. Dazu werden in der Arbeit einzelne Reformen bezüglich der Rechte und Pflichten von Frauen in der frühen Periode der Republik Türkei als einer der wichtigsten Aspekte der kemalistischen Kulturrevolution erläutert. Außerdem wird über Eigeninitiativen von namhaften Frauen aus der spätosmanischen und frührepublikanischen Zeit erzählt, die wesentlich zur Aufwertung der weiblichen Rolle in der patriarchalischen türkischen Gesellschaft beitrugen. Wie sich die Aussicht auf Bildung und Arbeit für die türkische Frau im Laufe der Geschichte der türkischen Republik und speziell durch die Reformpolitik Atatürks verändert hat, wird in den letzten beiden Kapiteln der Arbeit genau behandelt. Obwohl Frauen in der heutigen Zeit mehr Möglichkeiten eine angemessene Bildung zu erfahren offenstehen, haben Frauen noch immer mit Barrieren zu kämpfen, die vor allem mit den gesellschaftlichen Normen und Traditionen verbunden sind. So sieht ein Großteil der heutigen türkischen Gesellschaft die Frau, trotz ihrer rechtlichen Gleichstellung gegenüber dem männlichen Geschlecht, als jenes Gesellschaftsmitglied, das sich eher im privaten Bereich aufhalten und sich um Haushalt und Kinder kümmern sollte. Da in Kapitel drei spezifische Rechtstexte zu diesem Thema untersucht werden, können die Schlüsse aus den letzten Kapiteln besser verstanden werden. ; This master’s thesis is concerned with the juridical status of women in Turkey. The focus of this thesis lies on the developments of women’s capabilities to gain an adequate education and to gain access to the labour market in the Turkish Republic. To begin with, the first chapter gives a general insight into the history of Turkey’s constitution. In order to understand the changes of women’s role in Turkish society in particular, it is necessary to explain the first steps toward the first official republican constitution. Therefore, a brief overview of laws, which were passed during the Tanẓīmāt-period is given. The effects of these laws on the female population are discussed in this chapter. The next chapter deals with the founder of the Turkish Republic, namely Mustafa Kemal Atatürk, and the ideology of Kemalism concerning women and their status in society. In this respect, the chapter takes the women’s right to vote into account. Furthermore, the attempts of Turkish women to achieve equality during the late Ottoman and the early republican periods are outlined. In the following part the author of this thesis tries to explain women’s juridical status by reference to various legislative texts, which are translated from Turkish to German. Chapters four and five are concerned with the developments of girls’ and women’s role in Turkey’s educational system as well as in the world of employment in the course of time. The main aim is to point out that women in Turkey still have to cope with many cultural-societal barriers within a paternalistic society. According to the statistical findings, which are presented in the last two chapters, it is safe to say that equality between men and women by law does not mean equality in real life.
