Una de sus características principales es el uso complejo e inadecuado de la sintaxis, lo que hace que se creen oraciones y párrafos excesivamente largos y, por tanto, la comprensión del texto se vea afectada (Ministerio de Justicia, 2011, p. 13). Ante esto, en muchos países se ha planteado la necesidad de simplificar este lenguaje con el fin de conseguir que la Administración y la Justicia se acerquen al ciudadano (Toledo Báez, 2008; González Salgado, 2009, p. 3; Montolío Durán, 2012; Relinque Barranca, 2017). En este contexto, presentamos aquí el estudio de una muestra de sentencias estadounidenses y españolas del campo de la propiedad intelectual con el fin de comprobar si se aplican las recomendaciones para la simplificación del lenguaje jurídico aportadas por las políticas lingüísticas de los países correspondientes y por las campañas que defienden la claridad y simplificación de este lenguaje de especialidad. Para ello, se realiza un análisis macrotextual basado en el párrafo a través de dos corpus independientes compuestos por treinta sentencias originales estadounidenses (176.821 palabras) y treinta sentencias originales españolas (111.818 palabras). Para el análisis, se tomó como base el estudio de campo Lenguaje escrito, llevado a cabo por la Comisión para la Modernización del Lenguaje Jurídico (Ministerio de Justicia, 2011).
