Abstract:
Por meio deste trabalho é analisada a relevância da existência de previsão legal das hipóteses de licença compulsória de patentes de medicamentos. Especificamente, são propostos como objetivos os estudos do licenciamento compulsório no que tange à sua influência ao incentivo à pesquisa e desenvolvimento na indústria farmacêutica e à sua relação com a garantia à saúde da população brasileira. A investigação proposta tem sua base metodológica calcada na dialética e, essencialmente, nas técnicas de pesquisa de revisão bibliográfica e pesquisa legislativa. Assim, pretende-se partir de uma visão promovida pela análise de um modelo teórico da teoria dos jogos aplicado às negociações de preço de medicamentos entre países em desenvolvimento e os grandes laboratórios detentores de patentes farmacêuticas. Neste cenário, onde se identifica, à primeira vista, acentuado antagonismo entre diferentes direitos fundamentais, é observada uma relação de complementariedade. A partir da análise, são então tecidas as considerações referentes à previsão normativa da licença compulsória, cuja existência possibilita o cumprimento de uma função moderadora relativa à proteção do incentivo à inovação e à efetivação do direito fundamental à saúde. ; In this dissertation the compulsory license of pharmaceutical patents legal provision hypotheses is analyzed. More specifically, the aim of this work is the study of the compulsory license in what regards its impact to research and development in the pharmaceutic industry and its relation with health care in Brazil. The proposed investigation is based on the dialectical method and the research techniques used are essentially bibliographical review and legislative research. Thus, it is intended to base the view on the matter using a game theory-based model of drug price negotiation between developing countries and large pharmaceutical companies that have the patent ownership. In this scenario, at first look, there may be identified an antagonism between different fundamental rights, when, in truth, there is a relationship of complementarity. In light of the analysis, some considerations are done about the normative provision of the compulsory license, whose existence enables a moderating function observance relative to the innovation incentive protection and the fundamental right to health.
