Constituindo-se analítica e narrativamente a partir das ferramentas da genealogia de Nietzsche e Foucault e do procedimento rizomático de Deleuze e Guattari, problematiza-se: como e em que condições de possibilidade tornou-se possível a invenção do menor infrator, cujo estatuto de sujeito foi definido conceitual e imageticamente na sociedade brasileira a partir da diferenciação com a imagem e o lugar da criança? O texto foi estruturado em três partes com múltiplas seções: I) As formas do visível e as tecnologias da sujeição, na qual se faz uma arqueologia dos saberes que entre o fim do século XIX e início do XX produziram a diferença entre a criança e o menor considerado como “abandonado”, “delinquente” e “infrator”. Foram mobilizados periódicos, livros de intelectuais do Direito Penal, Psicologia e Serviço Social, constituições, códigos penal e civil, entre outros documentos, situando tais produções no campo de forças em que surgiu o Código de Menores de 1927; II) O rosto do infrator e as tiranias da identidade, em que se cartografa a rede de imagens, saberes e poderes que criou uma identidade para o menor infrator com forte apelo visual a partir dos anos 1950 e 1960. Foram arrolados imagens fotográficas, periódicos, filmes, reportagens de televisão, autobiografias, obras literárias, legislação e outras fontes que permitiram demonstrar como a materialidade corpórea do menor foi fabricada e reiterada; III) As figuras da resistência e os aparelhos de captura, em que se problematiza o campo de forças no qual o conceito-imagem do menor infrator foi questionado e desfeito jurídica e politicamente entre os anos 1970 e 1980. Dá-se ênfase para a Assembleia Nacional Constituinte (1987-1988), onde a Subcomissão da Família, do Menor e do Idoso desempenhou papel estratégico ao mobilizar gestores públicos, parlamentares e representantes da sociedade civil, incluindo crianças e adolescentes, contribuindo assim para a criação dos artigos 227 e 228 na Constituição Federal de 1988, regulamentados em 1990 pelo Estatuto da Criança e do Adolescente. Foram igualmente analisados os diversos modos de resistir ao dispositivo da menoridade, fosse por meio de resistências micropolíticas como a escrita autobiográfica de Anderson Herzer e Paulo Collen ou das rebeliões no interior da Fundação Estadual do Bem-Estar do Menor (FEBEM-SP). Em nível macropolítico outras estratégias contribuíram para desfazer tal invenção, tais como o Movimento em Defesa do Menor e a Campanha da Fraternidade da Conferência Nacional dos Bispos do Brasil (CNBB) que, em 1987, teve como lema “Quem acolhe o menor, a mim acolhe”. Assim, a tese cartografa a rede que tornou possível a emergência de uma diferença, observando o sujeito como lugar vazio, ocasião linguística e lugar a ser ocupado por determinados indivíduos em processos de sujeição. ; The thesis draws the minority device as an object of historical study, that is, the network of knowledge and powers that constituted the image-concept of the minor offender, being such a social and political invention mediated by social markers of difference such as race, class, age/generation, gender and sexuality. Constituting analytically and narratively from the tools of the genealogy of Nietzsche and Foucault and the rhizomatic procedure of Deleuze and Guattari, we problematize: how and under what conditions of possibility did the invention of the minor offender become possible, whose subject status was defined conceptually and imagery in Brazilian society from differentiation with the child's image and place? The text was structured in three parts with multiple sections: I) The forms of the visible and the technologies of subjection, in which an archeology of knowledge is made that between the end of the 19th century and the beginning of the 20th produced the difference between the child and the child considered as “abandoned”, “delinquent” and “offender”. Periodicals, books on intellectuals from Criminal Law, Psychology and Social Work, constitutions, penal and civil codes, among other documents, were mobilized, placing such productions in the field of forces in which the 1927 Code of Minors emerged; II) The face of the offender and the tyrannies of identity, in which the network of images, knowledge and powers is mapped, which created an identity for the smallest offender with strong visual appeal from the 1950s and 1960s. Photographic images, periodicals, films, television reports, autobiographies, literary works, legislation and other sources were listed to demonstrate how the minor's bodily materiality was manufactured and reiterated; III) The figures of resistance and capture devices, in which the field of forces in which the concept-image of the minor offender was questioned and undone legally and politically between the 1970s and 1980s is problematized. We highlight the National Constituent Assembly (1987-1988), where the Subcommittee on Family, Minors and the Elderly played a strategic role in mobilizing public managers, parliamentarians and representatives of civil society, including children and adolescents, thus contributing to the creation of articles 227 and 228 in the 1988 Federal Constitution, regulated in 1990 by the Statute of Children and Adolescents. The various ways of resisting the minority device were also analyzed, whether through micropolitical resistances such as the autobiographical writing of Anderson Herzer and Paulo Collen or the rebellions within the State Foundation for the Welfare of Minors (Fundação Estadual do Bem-Estar do Menor – FEBEM-SP). At the macro-political level, other strategies contributed to undo this invention, such as the Movement in Defense of Minors and the Fraternity Campaign of the National Conference of Bishops of Brazil (Conferência Nacional dos Bispos do Brasil – CNBB), which, in 1987, had the motto “Who welcomes the child, welcomes me”. Thus, the thesis maps the network that made possible the emergence of a difference, observing the subject as an empty place, linguistic occasion and place to be occupied by certain individuals in subjection processes. ; La thèse dessine le dispositif minoritaire comme un objet d'étude historique, c'est-à-dire le réseau de connaissances et de pouvoirs qui constituait le concept d'image du délinquant mineur, étant une telle invention sociale et politique médiée par des marqueurs sociaux de différence tels que la race, la classe, l'âge / génération, genre et sexualité. Constituant analytiquement et narrativement les outils de la généalogie de Nietzsche et Foucault et de la procédure rhizomatique de Deleuze et Guattari, nous problématisons: Comment et dans quelles conditions de possibilité l'invention du délinquant mineur est-elle devenue possible, dont le statut de sujet a été défini conceptuellement et imagerie dans la société brésilienne à partir de la différenciation avec l'image et le lieu de l'enfant? Le texte était structuré en trois parties avec plusieurs sections: I) Les formes du visible et les technologies de l'assujettissement, dans lesquelles se fait une archéologie du savoir qui, entre la fin du XIXe siècle et le début du XXe, a fait la différence entre l'enfant et le plus jeune considéré comme «abandonné» et «délinquant». Des périodiques, des livres sur les intellectuels du droit pénal, de la psychologie et du travail social, les constitutions, les codes pénal et civil, entre autres documents, ont été mobilisés, plaçant ces productions dans le champ des forces où le Code des mineurs de 1927 a émergé; II) Le visage du délinquant et les tyrannies de l'identité, dans lequel le réseau d'images, de connaissances et de pouvoirs est cartographié, qui a créé une identité pour le plus petit délinquant avec un fort attrait visuel des années 1950 et 1960. Des images photographiques, des périodiques, des films, des reportages télévisés, des autobiographies, des oeuvres littéraires, des lois et d'autres sources ont été répertoriés pour démontrer comment la matérialité corporelle du mineur a été fabriquée et réitérée; III) Les figures de la résistance et des dispositifs de capture, dans lesquels le champ de forces dans lequel l'image-conceptuelle du délinquant mineur a été remise en cause et défait juridiquement et politiquement entre les années 1970 et 1980 est problématisé. L'accent est mis sur l'Assemblée nationale constituante (1987-1988), où la sous-commission de la famille, des mineurs et des personnes âgées a joué un rôle stratégique en mobilisant les gestionnaires publics, les parlementaires et les représentants de la société civile, y compris les enfants et les adolescents, contribuant ainsi à la création des articles 227 et 228 de la Constitution fédérale de 1988, régis en 1990 par le statut de l'enfant et de l'adolescent. Les différentes manières de résister au dispositif minoritaire ont également été analysées, soit à travers les résistances micropolitiques telles que l'écriture autobiographique d'Anderson Herzer et Paulo Collen, soit les rébellions au sein de la Fondation d'État pour le bien-être des mineurs (Fundação Estadual do Bem-Estar do Menor - FEBEM-SP).
