Abstract:
Введение: в статье анализируется нотариат как институт, который обеспечивает защиту прав и законных интересов граждан и юридических лиц. В связи с этим исследуются отдельные механизмы защиты прав участников гражданского оборота. Тема исследования приобретает особую актуальность в условиях отмеченного роста преступности на российском рынке недвижимости. Цель: проведение общетеоретического исследования о правозащитных функций нотариата в условиях действующего законодательства с учетом уровня информационно-технологического развития нотариата, а также формулирование предложений относительно перспектив развития нотариата в современных условиях. Методологическая основа: историко-правовой метод, сравнительный метод исследования, диалектический метод научного познания. Результаты: установлено, что в условиях цифровизации гражданского оборота реализация правозащитной функции нотариата происходит с привлечением цифровых инструментов и созданной для этого электронной инфраструктуры, которые в своей совокупности ... : Background: the article analyzes the notary as an institution that protects the rights and legitimate interests of citizens and legal entities. In this regard, certain mechanisms for protecting the rights of participants in civil turnover are being investigated.
