Abstract:
Введение: в российском законодательстве в области обеспечения транспортной безопасности имеется терминологическая и понятийная неопределенность. Используются термины, схожие по звучанию, но различные по содержанию: «транспортная безопасность», «безопасность на транспорте», «безопасность на объектах транспорта». Понятие «система транспортной безопасности» не определено. Цель: разработка предложений по унификации указанных терминов; определение их смыслового значения на основе анализа лингвистических источников, международного и российского законодательства, мнения ученых различных отраслей права. Методологическая основа: общенаучные и частнонаучные (логико-юридический, сравнительно-правовой) методы познания. Результаты: предложенные автором определения базовых понятий транспортной безопасности могут быть использованы при внесении изменений в законодательство, регулирующее рассматриваемую область правоотношений. Выводы: система транспортной безопасности представляет собой совокупность органов, организаций и ... : Background: in the Russian legislation in the field of transport security, there is a terminological and conceptual uncertainty. The terms used are similar in sound, but different in content: “transport security”, “transport security”, “security at transport facilities”. The concept of “transport security system” is not defined. Objective: development of proposals for the unification of the terms used in legislation on transportation security; determination of their semantic meaning based on the analysis of linguistic sources, international and Russian legislation, the opinions of scientists from various branches of law. Methodology: general scientific and private scientific (logical-legal, comparative-legal) methods of cognition. Results: the definitions of the basic concepts of transport security proposed by the author can be used when making changes to the legislation regulating the area of legal relations under consideration.
