Abstract:
À travers l’examen de la question des conflits au travail à l’Université française et leur judiciarisation, cette contribution s’intéresse au rôle joué par l’examen des corpus linguistiques dans l’évaluation de possibles infractions pénales. Une analyse scientifique de la « part langagière » (Boutet 2001) du conflit au travail qui viendrait informer, voire influencer, la qualification des faits par le juge est-elle vraiment souhaitable ? Dans la continuité de travaux antérieurs, l’objet de cette réflexion est de dépasser les déclarations en matière d’éthique des experts linguistes en cours de justice (ne pas prendre partie, neutralité, etc. : garde-fous autant illusoires que systématiquement mis en avant dans ces évaluations), pour affirmer la nécessité d’une prise de position épistémologique – et donc politique – sur le statut et l’interprétation de cette part langagière du conflit au travail, soumise au juge et, parfois, à des experts. ; By considering the issue of workplace conflicts at French universities and their judicialization, this contribution focuses on the role played by the examination of linguistic corpora when assessing possible criminal offences. Is a scientific analysis of the “linguistic element” (Boutet 2001) that will inform, or even influence, the classification of facts by a judge in a case of workplace conflict really desirable? Building on previous work, the purpose of this reflection is to go beyond the ethical statements of expert linguists in the courts (not taking sides, maintaining neutrality, and so on: safeguards that are both illusory and systematically highlighted in these evaluations), to affirm the need for an epistemological—and therefore political—position on the status and interpretation of this linguistic element of workplace conflict, submitted to a judge and, sometimes, to experts. ; Mediante el examen de los conflictos en el entorno laboral en la Universidad francesa y su judicialización, la presente contribución estudia el papel desempeñado por el examen de los corpus lingüísticos en la evolución de las posibles infracciones penales. ¿Sería verdadera mente deseable un análisis científico de la « parte lingüística » (Boutet 2001) del conflicto en el trabajo que pudiera informar o incluso influir en la calificación de los hechos por parte del juez? En la línea de anteriores trabajos, el objeto de esta reflexión es ir más allá de las declaraciones éticas de los expertos lingüistas que asisten a la justicia (no tomar parte, neutralidad, etc.: salvaguardias ilusorias y sistemáticamente esgrimidas en estas evaluaciones), para afirmar la necesidad de una toma de posición epistemológica —y, por tanto, política— sobre el estatus de la interpretación de esta parte lingüística del conflicto en el trabajo que se presenta ante el juez y, en ocasiones, también ante los expertos.
