Abstract:
Предметом исследования выступают нормы законодательства, содержащие оценочные категории, рассматриваемые как структурные элементы правотворческой и правореализационной техники применительно к российской правовой доктрине и современной юридической практике. Автор исследует оценочные категории, которые используются при конструировании норм частных и публичных отраслей права и находят свое выражение в форме нетипичных нормативных построений и предписаний (правовых презумпций, нормативных обобщений, принципов, общих оговорок); закрепляются в гипотезах, диспозициях и санкциях статей. Уделено внимание проблемам законодательного формулирования и применения норм, содержащих оценочные категории. В процессе подготовки настоящей статьи применялись такие методы и приемы мышления, как анализ, синтез, индукция, дедукция, которые позволили выделить особенности оценочных категорий как приема юридической техники. С помощью исторического метода рассматривались нормативные формы закрепления оценочных категорий в источниках права. На основе системного и структурно-функционального методов раскрывается роль данного приема юридической техники в механизме правового регулирования; выделяются особенности применения оценочных категорий. Не менее продуктивным является междисциплинарный метод, заключающийся в исследовании оценочных категорий с позиций теоретической и отраслевой юриспруденции, а также иных сфер гуманитарного знания. Обосновывается положение о том, что оценочные категории в различных отраслях права находят свое внешнее выражение в общих оговорках, нормативных обобщениях, презумпциях, принципах. С точки зрения юридической техники, фиксация оценочных категорий осуществляется в зависимости от структуры правовой нормы, предмета, подвергаемого оценке. Аргументируется необходимость законодательного закрепления проведения научно-лингвистической экспертизы проектов нормативных правовых актов, в которые включены нравственно-правовые оценочные категории; а также правил включения в нормативно-правовой акт оценочных категорий. Автором указано на важность профессиональной подготовки правоприменителей в вузах с упором на нравственное воспитание. ; Review. The object of studies involves legislative norms, including evaluative categories, which are regarded as being structural elements of the law-making and law-implementing techniques within the framework of the Russian legal doctrine and modern legal practice. The author studies evaluative categories, which are involved in the construction of legal norms within various branches of public and private law, and which are manifested as non-typical normative constructions and prescriptions (legal presumptions, normative generalizations, general reservations), being provided for in hypotheses, dispositions and sanctions of the articles. The author pays attention to the problems of legal regulation and application of norms containing evaluative categories. In the process of preparing this article the author used cognitive means and methods, such as analysis, synthesis, induction, deduction, which have allowed to single out the specific features of evaluative categories as a legal techniques. With the help of the historical method, the author evaluated the normative forms of the provisions for the evaluative categories within the sources of law. Based upon systemic and structural-functional methods the author shows the role of this legal technique within the mechanism of legal regulation, singling out the specificity of evaluative categories application. The interdisciplinary method is no less productive, and it allows to appreciate the evaluative categories from the standpoints of theoretical jurisprudence and other branches of jurisprudence, as well as other humanities. The author substantiates the position that evaluative categories in various branches of law are manifested as general reservations, normative generalizations, presumptions and principles. From the standpoint of legal technique, provisions for evaluative categories depend upon the structure of legal norm and the subject, which is being evaluated. The author substantiates the need for the legislative provisions for the scientific linguistic expertise of the drafts of normative legal acts involving normative legal evaluative categories, as well as for the rules for inclusion of evaluative categories into a normative legal act. The author also points out the importance of professional education of legal practitioners in the higher education institutions with due attention to the moral education.
