Abstract:
The purpose of this paper is to recover the nomination of the Law of Domestic Violence against women, in order to understand both the characteristics of this name from the point of view of Onomastics and from the legal point of view, that is, the reasons that made a Criminal Law be named with a person's proper name. Thinking about the characteristics of proper names, a study was made of the origin of the names “Maria” and “da Penha” and their incidence in Brazil. A timeline of the life story of Brazilian Maria da Penha was also built, from when she was the victim of two assassination attempts by her ex-husband, to her long national and international legal battle which ended up in a recommendation to the Brazilian State, in order to draft legislation in favor of women victims of domestic violence and. Through her struggle, Maria da Penha won the right to a symbolic reparation from the country, which was done by naming the legislation in her proper name. ; O objetivo desse artigo é recuperar a nomeação da Lei de Violência Doméstica contra a mulher, a fim de compreender tanto as características desse nome do ponto de vista da Onomástica quanto do ponto de vista jurídico, isto é, dos motivos que fizeram uma Legislação Penal ser nomeada com um nome próprio de pessoa. Pensando nas características dos nomes próprios, foi feito um estudo da origem dos nomes “Maria” e “da Penha” e sua incidência no Brasil. Também foi construída uma linha do tempo da história de vida da brasileira Maria da Penha, desde quando foi vítima de duas tentativas de assassinato por seu ex-esposo, até sua longa batalha judicial nacional e internacional a qual acabou rendendo uma recomendação ao Estado Brasileiro, a fim de que elaborasse uma legislação em favor das mulheres vítimas de violência doméstica e, por sua luta, ganhou o direito a uma reparação simbólica do país, a qual foi feita com a nomeação da legislação com seu nome próprio.
