Abstract:
A presente dissertação trata da relação entre o valor da tolerância e o Direito Internacional Privado, especificamente no que se refere às normas de conflito de leis no espaço. A fim de se alcançar uma terceira via, utiliza-se a interpretação triádica da dicotomia entre a (i) coordenação harmônica interestatal típica do pensamento de Savigny em relação à (ii) expansão axiológica sobre as fontes do Direito Internacional Privado ocorrida ao longo do século XX. Esta dissertação se divide em duas partes. A primeira parte enquadra o Direito Internacional Privado no Direito; contém dois capítulos e uma conclusão parcial. O primeiro capítulo aborda o problema da diversidade de culturas no mundo, trazendo um breve histórico do estudo do método conflitual. O segundo apresenta a constelação axiológica do Direito Internacional Privado, isto é, um rol dos principais valores informadores desta disciplina. A conclusão parcial demonstra o problema desta pesquisa: qual deve ser a concepção sobre o Direito Internacional Privado perante o cenário de pós-neutralidade das normas de conflitos? Seguindo adiante, a segunda parte da presente dissertação reflete sobre a iluminação do valor da tolerância no conflito de leis no espaço. No terceiro capítulo, recorre-se às lições de Bobbio e sua teoria a fim de suscitar uma \"Filosofia do Direito Internacional Privado\" e buscar respostas para o problema desta pesquisa. No quarto capítulo, abrem-se os flancos de incidência do valor da tolerância nos conflitos de leis no espaço, especificamente diante da diversidade linguística, da tradução, dos conflitos de cultura e da estética. Em relação a esta última, tratar-se-á de um paralelo oportunizado pela abertura instrumental característica ao juízo estético. Ao final, apresenta-se a conclusão acerca da terceira via da dicotomia triádica (coordenação/valores) consistente na concepção tolerante do método conflitual. ; This dissertation deals with the relationship between the value of tolerance and Private International Law, specifically concerning the rules of conflict of laws. In order to reach a third way, the triadic interpretation of the dichotomy between the (i) interstate harmonic coordination typical of Savigny's thought in relation to the (ii) axiological expansion of the sources of Private International Law that occurred over the twentieth century. This dissertation is divided into two parts. The first part frames Private International Law in Law; it contains two chapters and a partial conclusion. The first chapter deals with the problem of cultural diversity in the world, presenting a brief history of the study of the conflict method. The second chapter presents the axiological constellation of Private International Law, namely, a list of the main informing values of this subject. The partial conclusion indicates the problem of this research: what should be the conception of Private International Law in view of the post-neutrality scenario of conflict norms? Going forward, the second part of this dissertation reflects on the illumination of the value of tolerance in the conflict of laws. In the third chapter, we use Bobbio's lessons and his theory in order to incite a \"Philosophy of Private International Law\" and seek answers to the problem of this research. In the fourth chapter, open flanks of the incidence of value of tolerance in the conflict of laws are presented, specifically regarding linguistic diversity, translation, cultural conflicts and aesthetics. In relation to the latter, a parallel drawn by the instrumental openness characteristic of the aesthetic judgment shall be dealt with. In the end, one can conclude for the third way of the triadic dichotomy (coordination/values) consistent of the tolerant conception of the conflict method.
