Abstract:
Данное исследование посвящено проблематике правовой определенности личности в рамках различных правовых концепций, сформировавшихся в юридической доктрине и практике разных стран. Целью работы является анализ содержательной характеристики правовой определенности личности в контексте доктрин «верховенства права» и «правового государства». Для достижения поставленных задач автор использует как общенаучный диалектический метод, позволяющий уяснить двойственность понимания рассматриваемых юридических категорий, так и методы формальной логики, сравнительный метод, системно-структурный метод и др. Автор анализирует особенности этих доктрин исходя из специфических характеристик формирования в них концепта основных прав и особенностей гарантирования и защиты прав и свобод человека. В результате исследования автор приходит к выводу, что на современном этапе развития и концепция «верховенства права», и доктрина «правового государства» требуют наличия в правовом поле содержательных характеристик фундаментальных прав ... : This work focuses on legal certainty of the individual within the framework of various legal concepts developed in the legal doctrine and practice of different countries. The purpose of this work is to analyse the substantive characteristic of the legal certainty of the individual in the context of the doctrines of "ruleoflaw" and "rechtsstaat." In order to achieve the objectives, the authors use both the national scientific dialectical method, which allows to understand the ambivalence of understanding of the legal categories under consideration, as well as methods of formal logic, comparative method, system-structural method, etc. The author analyses the peculiarities of these doctrines on the basis of the specific characteristics of their formation of the concept of "fundamental rights" and the peculiarities of guaranteeing and protecting human rights and freedoms.
