Abstract:
A gestação de substituição é uma técnica de procriação medicamente assistida que pressupõe um acordo através do qual uma mulher gera uma criança no seu ventre com o fim de a entregar a outros. É uma prática médica que no Estado Moderno é regulada pelo poder judicial. O objetivo desta dissertação é fornecer pistas para pensar o debate em torno da lei da gestação de substituição em Portugal. A questão orientadora do debate jurídico é: como devemos legislar? A preocupação é escrever uma lei que acautele ao máximo os interesses das três partes, pais intencionais, gestante e criança, minimizando os riscos. Nesta dissertação trabalhamos questões de ordem científica, jurídica, linguística e relacional. Como surge a prática da gestação de substituição? Como é que o corpo da mulher foi orientado no debate público, científico e religioso? Ilustraremos questões levantadas no debate a partir de três casos controversos: Baby M, Baby Manji e Baby Gammy. Teoricamente a gestação de substituição seria uma situação de win-win. Contudo, o que vemos nestes casos é que tal não se verificou. Como é que os media abordam a questão da gestação de substituição? Como a colocam no debate público? Propomos olhar para esta realidade alterando a pergunta: quais as implicações da gestação de substituição nas vidas familiares e no futuro da saúde pública? ; Surrogate motherhood is a practice of assisted medical process through which a woman generates a child in her womb in order to deliver him to others. It is a medical practice regulated by the judicial power in the modern state. The purpose of this dissertation is to provide clues to think about the debate around the surrogacy law in Portugal. The guiding question of legal debate is how we should legislate. The main concern is to write a law that reaches the maximum interests of the three parties, intentional parents, surrogate mother and child, while minimizing the risks. In this dissertation we will work questions of the scientific, juridical, linguistic and relational domains. How does surrogacy practice emerge? How were the women bodies oriented in the public, scientific and religious debate? We will discuss questions from three controversial international cases: Baby M, Baby Manji and Baby Gammy. Theoretically, surrogacy would be a win-win situation. However, this has not happened in the aforementioned examples. How is media approaching surrogacy? How do they place this matter in the public debate? We propose to look at this reality by changing the question: what are the implications of surrogacy in the family lives and in the future of public health?
