Cuando la lengua se convierte en odio

Abstract:
Lamentablemente casi no hay día en el que aparezca una noticia relacionada con los delitos de odio en sus diferentes tipologías de manifestación que incluyen cualquier infracción penal, ya sean infracciones contra las personas o las propiedades, donde la víctima, el local o el objetivo de la infracción se elija por su, real o percibida, conexión, simpatía, filiación, apoyo o pertenencia a un grupo. En el caso de los grupos se requiere un fundamento que radique en una característica común de sus miembros, como su raza real o perceptiva, el origen nacional o étnico, el lenguaje, el color, la religión, el sexo, la edad, la discapacidad intelectual o física, la orientación sexual u otro factor similar. En el presente artículo explicamos un caso muy peculiar de una denuncia por delito de odio a un ilusionista que en una actuación cambió del idioma catalán a la lengua española, porque según él lo hacía para dar más miedo. Un colectivo de una asociación se ha sentido discriminado y ha decidido interponer una querella criminal contra el mago que estaba actuando en un programa de televisión de Cataluña ante una audiencia bilingüe en su inmensa mayoría. Mediante el concepto penal de delito de odio, analizaremos su estructura con detalle tomando sustento de la más autorizada doctrina científica y jurisprudencia. A lo largo del artículo planteamos una serie de cuestiones con relación al caso que comentamos e intentamos dar respuesta mediante una serie de conclusiones ; Unfortunately, there isn’t hardly ever a day when a news about hate crimes appears in their different types of manifestation that include any criminal offense, whether they are offenses against people or property, where the victim, the premises or the target of the offense is chosen by their, real or perceived, connection, sympathy, affiliation, support or belonging to a group. In the case of groups, a foundation is required that lies in a common characteristic of its members, such as their real or perceptual race, national or ethnic origin, language, color, religion, sex, age, intellectual or physical disability, sexual orientation or another similar factor. In this article we explain a very peculiar case of a hate crime complaint against an illusionist who changed from Catalan to Spanish language in a performance because, according to him, he did it to give more fear. A group of an association has felt discriminated against and has decided to file a criminal complaint against the magician who was performing in a Catalan television program before a vast majority of bilingual audiences. Through the criminal concept of hating crime, we will analyze its structure in detail, based on the most authoritative scientific doctrine and jurisprudence. Throughout the article we raise some series of questions in relation to the case that we are commenting on and we try to answer through different series of conclusions
